Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Zasenami (“Zasenami,” “we,” “us,” or “our”), the maker of Zabeau (the “App” or “Service”). By downloading, accessing, or using Zabeau, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 16 years old, or the minimum age of digital consent in your country, to use Zabeau. If you are using the App on behalf of someone else, you confirm you are authorized to accept these Terms for them.

Zabeau is a recomposition-focused fitness app. The free tier is a full tracker for food, training, weight, and progress. Optional paid tiers add an AI coach that reads your logged numbers, proposes plan changes you can apply, suggests adjustments, and can generate reviews. The AI coach is powered by advanced AI and produces informational guidance only.

We are continuously improving the App. We may add, change, or remove features at any time. We do not guarantee that any particular feature, food item, exercise, or AI capability will always be available.

Zabeau is not a medical device and does not provide medical, clinical, psychological, or professional dietary advice. Anything the App or its AI coach tells you — calorie or macro targets, training suggestions, weight guidance, food analysis, or body-composition estimates — is general fitness and nutrition information, not a diagnosis or treatment plan.

The assistant on our website. The chat assistant on Zabeau’s website is an AI. Its answers can be incomplete or wrong, they are general information about the product and about fitness — never medical advice, never a personal plan, and never a substitute for a professional. Nothing it says creates an obligation, a price, or a promise on our part; the terms and prices in the App and on this site govern.

Always consult a qualified physician, registered dietitian, or other licensed professional before starting, changing, or stopping any diet, exercise, supplement, or health program — especially if you are pregnant or nursing, have an eating disorder or a history of one, have diabetes or a heart, kidney, or metabolic condition, or take medication that interacts with food intake or activity. Never disregard or delay professional advice because of something you read or were told in Zabeau.

Eating-disorder and crisis safety. Zabeau includes guardrails against under-eating and surfaces region-aware eating-disorder and crisis resources. These are supportive features, not a substitute for professional care. If you are in crisis or think you may be developing a disordered relationship with food or exercise, please contact a medical professional or a crisis line in your region immediately.

You use Zabeau and act on its guidance at your own risk.

Zabeau offers paid subscription tiers: Coach ($12.99/month, or $99.99/year) and Pro ($24.99/month, or $189.99/year). The core tracker is free. Prices may vary by region and currency and may change over time; any change applies only to future billing periods.

Subscriptions are sold and billed through the Apple App Store or Google Play and are subject to that store’s terms. Payment is charged to your store account at confirmation of purchase. Subscriptions renew automatically and your account is charged for the next period within 24 hours before the current period ends, unless you turn off auto-renew at least 24 hours before then.

Canceling and refunds. You manage and cancel your subscription in your store account settings (on iOS: Settings → your name → Subscriptions; on Android: Google Play → your profile → Payments & subscriptions), not inside Zabeau. You can cancel anytime. Canceling stops future renewals, but you keep paid access until the end of the current billing period — after which your account reverts to the Free tier. Zasenami does not provide partial or pro-rated refunds for the unused portion of a billing period. Any refunds are handled by Apple — and by Google Play on Android — under their respective policies; we generally cannot issue refunds directly. If you downgrade or cancel, you keep full access to your logged history and the complete free tracker — you can keep viewing, editing, and logging. Only Coach/Pro AI features stop at the end of the paid period.

When you use Zabeau, you agree not to:

• Break the law, or use the App to harm yourself or others.
• Reverse-engineer, decompile, scrape, or attempt to extract the source code, models, or prompts behind the App or its AI coach, except where the law expressly permits it.
• Probe, overload, disrupt, or circumvent rate limits, usage caps, security, or subscription-tier enforcement, or access the Service through automated means.
• Submit content that is unlawful, abusive, or infringes someone else’s rights, or impersonate another person.
• Resell, sublicense, or commercially exploit the App without our written permission.

We may suspend or limit access to protect the Service, other users, or the AI provider’s usage policies.

You own the data you put into Zabeau — your food, training, weight, photos, and notes. You grant us a limited license to process that data only as needed to operate the Service for you: to store it, sync it, render your trends, and — if you subscribe to a coaching tier — to send the relevant numbers to our AI provider so the coach can respond.

You can export or delete your data at any time, including full in-app account deletion. For privacy details — including our zero health-data telemetry scrub — see our Privacy Policy, which is incorporated into these Terms. Privacy and data requests go to privacy@zabeau.app.

Some email is part of the Service itself: confirming your address, resetting your password, receipts, renewal and failed-payment notices, and other messages about your account or these Terms. We send those to the address on your account for as long as you have one, and they are not marketing.

Marketing email is opt-in. We send coaching tips, a note when your Weekly Review is ready to read in the App, product news, and the occasional message about your subscription if you cancelled or let it lapse. We send them only if you gave us your express consent — by ticking the optional box in the App (onboarding, or Settings → Email), or by confirming your address after signing up on our website. The box is never pre-ticked, and no part of Zabeau is withheld if you decline.

You can withdraw at any time. Turn the toggle off in Settings → Email, use the unsubscribe link at the bottom of any marketing email we send you, or write to unsubscribe@zabeau.app. We act on a withdrawal without delay and at no cost to you.

Every message in our lifecycle email program — the marketing messages above and the account messages we send alongside them, such as a welcome or a failed-payment notice — identifies Zasenami as the sender and carries our mailing address, a working contact address, and an unsubscribe mechanism that stays valid for at least 60 days after the message is sent, as required by Canada’s anti-spam legislation (CASL).

Authentication emails are the one exception, by design: confirming your address, resetting your password, or telling you a password just changed. They identify Zabeau and Zasenami and carry a support address you can reply to, but they have no unsubscribe link — you cannot turn off the message that lets you back into your own account. They are never marketing and we send no others in that channel.

Zabeau, its name, logo, design, software, and content (other than your own data) are owned by Zasenami and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial fitness tracking, subject to these Terms. No other rights are granted.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, that food data, AI estimates, or body-composition imports will be accurate, or that the App will meet your goals. Nutritional and AI-generated values are estimates and can be wrong — use your own judgment.

To the fullest extent permitted by law, Zasenami and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health outcomes, arising from your use of — or inability to use — the App, even if we have been advised of the possibility. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD $50.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

You can stop using Zabeau at any time and delete your account in-app. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required to protect the Service or comply with the law. On termination, your license to use the App ends; clauses that by their nature should survive (such as disclaimers, limitation of liability, and intellectual property) continue to apply.

We may update these Terms as the App evolves. When we make material changes, we’ll update the effective date above and, where appropriate, notify you in the App. Your continued use after changes take effect means you accept the updated Terms. If you don’t agree, stop using the App.

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts located in Quebec will have jurisdiction over disputes, except where mandatory consumer-protection laws in your place of residence give you the right to bring claims locally. Your use of the App is also subject to the Apple App Store terms (and Google Play terms on Android).
